These Terms of Use ("Terms") are a binding agreement between you ("you," "your," or "Member") and Eurika LLC, a Wyoming limited liability company doing business as The Trade Tribe HQ ("Company," "we," "us," or "our"), operating from Hawaii, and govern your access to and use of the website located at https://www.tradetribehq.com (the "Site"), our Circle-hosted community (the "Community"), and any related content, tools, or services (collectively, the "Services").
By creating an account, accessing the Site, or joining the Community, you agree to these Terms. If you do not agree, do not use the Services.
1. Who We Are
The Trade Tribe HQ is a trading education and community platform. We provide educational content, discussion, and a core group environment for people learning to trade. We are not a registered investment advisor, broker-dealer, or financial planner, and nothing on the Site or in the Community constitutes personalized financial, investment, tax, or legal advice. See our full Disclaimer, which is incorporated into these Terms by reference.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services, you represent that you meet these requirements. The Services are directed primarily at users in the United States; if you access the Services from outside the U.S., you are responsible for compliance with your local laws.
3. Accounts and the Circle Community
Access to the Community is provided through Circle, a third-party platform. Creating a Circle account for our Community is subject to Circle's own terms and privacy policy in addition to these Terms. You are responsible for:
Providing accurate registration information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
We are not responsible for any loss arising from unauthorized use of your account, though we ask that you notify us promptly at erica@tradetribehq.com if you suspect unauthorized access.
4. Membership and Payments
As of the Effective Date, membership is free. If and when paid membership tiers or courses launch, additional terms — including pricing, billing cadence, and refund policy — will be presented to you at the time of purchase and will supplement these Terms. Payment processing for any paid offerings will be handled directly by Circle and/or its payment processor, and your payment information is subject to their respective terms and privacy practices, not ours.
5. Community Conduct
The Trade Tribe HQ is built around being a "core group," not a faceless course. To keep that intact, you agree not to:
Harass, threaten, or abuse other members
Post spam, unsolicited promotions, or affiliate links unrelated to community discussion
Impersonate any person or misrepresent your affiliation
Share another member's trades, personal information, or private discussions outside the Community without consent
Post unlawful, defamatory, or infringing content
Use the Community to solicit members into unrelated paid programs, signal services, or investment schemes
We reserve the right to remove content and suspend or terminate accounts that violate these standards, at our discretion.
6. User-Generated Content
Any trade ideas, commentary, charts, or other content you post in the Community ("User Content") remains yours, but by posting it you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute it within the Services for the purpose of operating and promoting the Community (for example, sharing a win in a testimonial, with your consent). You are solely responsible for your User Content and confirm you have the right to share it.
Nothing posted by any member — including moderators, hosts, or the Company's founder — constitutes individualized investment advice. Views shared by members are their own opinions, not recommendations.
7. Intellectual Property
All Site content, branding, course materials, videos, and educational frameworks (excluding User Content) are owned by Eurika LLC or its licensors and protected by copyright and trademark law. You may not copy, redistribute, resell, or create derivative works from our materials without written permission.
8. No Guarantees / Assumption of Risk
Trading and investing involve substantial risk of loss. You acknowledge that any decision to trade or invest based on information learned through the Services is made entirely at your own risk, and that the Company makes no representation or guarantee regarding profits, results, or suitability for your personal financial situation. 9. Disclaimers of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY EDUCATIONAL CONTENT WILL LEAD TO PROFITABLE TRADING OUTCOMES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EURIKA LLC, ITS FOUNDER, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, TRADING LOSSES, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON ANY CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
11. Indemnification
You agree to indemnify and hold harmless Eurika LLC and its founder, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, your trading activity, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. You may leave the Community at any time by canceling your Circle account.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, without prejudice to any mandatory consumer protection laws of your state or country of residence. Any dispute arising from these Terms or the Services will first be attempted to be resolved informally by contacting erica@tradetribehq.com. (Optional: you may later want to add a formal arbitration clause here — flag if you'd like one drafted.)
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance.
